If you want to earn money while you study, there are some rules you need to know. In this section you will find out how many hours you are allowed to work in a month, what documents you will need, and how to find a job.

Work permit

Whether foreign students or researchers may work in Austria, depends on their nationality, the kind of activity and - for the third world citizens - on the type of the residence title they have.

•    Citizens of Belgium, Denmark, Germany, Finland, France, Greece, Great Britain, Ireland, Iceland, Italy, Liechtenstein, Luxembourg, Malta, the Netherlands, Norway, Portugal, Sweden, Switzerland, Spain and Cyprus may work in Austria without any special permission
•    Citizens of Bulgaria, Estonia, Latvia, Lithuania, Poland, Romania, Slovakia, Slovenia, Czech Republic and Hungary need a working permission due to temporary agreements for the admission of a dependent or employee-similar gainful employment, if the activity is not excluded by the law concerning the employment of the foreigners. Excluded are e.g. exchange or research programs of the European Union and the scientific teachings and researches.
•    Students from all remaining states („third world states "), which possess the "studying" residence permission, may, to some extent and with consideration of the regulations of the employment of alien laws, which as a rule require an occupation grant, start working. It is important to consider the following regulations exactly since an injury can lead to strict punishments and to the imposition of a ban on residence. If in doubts, one should absolutely inquire before obtaining a gainful employment with the job market service (AMS) or a consultative organization.

Working Terms & Conditions

Minor Occupation

A minor occupation is present, if you work on the basis of a contract of employment or a free contract of employment and the monthly income does not exceed the border of Euro 349,01 (2008 conditions). If the (free) service contract is agreed upon for a shorter time than a calendar month, in addition to the above a minimal income border at a value of Euro 26,80 is valid. The minimal income is generally regulated by the social security law (ASVG) and adapted to the inflation annually.

Holiday Job

There isn't any form of occupation, which covers the holiday jobs. It depends on that into which category (more genuine/free contract of employment, work contract) falls your holiday job.

It is differentiated thereby between the following categories:

•    Voluntary service: the principal purpose of a voluntary service is to acquire a practical knowledge without having to carry out duties or work, and therefore also without requirement for payment. Therefore there is also no contract of employment. In case of this kind of occupation applies neither the decisional authority nor a binding work time law.
•    Holiday practical course: it is type of a training taken in an enterprise during holidays. Such practical courses are usually an obligatory addition to the theoretical training regulated by the curricula. If you participated in business operations, then it can be seen as genuine service relationship. That is, however, not necessarily the case.
•    Holiday job: The most frequent motive for work during holidays is naturally to make money. Apart from the time limitation of the contract the same rights and obligations apply as to other service conditions to holiday jobs. If you are hired on the basis of a collective contract, you are entitled to the following rights: monthly wages or earnings, proportionate (aliquot) special payments, vacation and Christmas benefit as well as vacation compensation remuneration for the vacation which is entitled but not taken).
